Preamble

These terms of use are entered into between:

  • The manager of the website, hereinafter referred to as the \"Publisher\",
  • Any person wishing to access the website and its services, hereinafter referred to as the \"User\".

Article 1 - Principles

Business Profilers offers an intermediation or direct booking service enabling the reservation of services, in particular venues intended for professional events, with professional providers (hereinafter the « providers ») and organizers of professional events and meetings (hereinafter the « users »)

These terms of use are intended to provide the legal framework for the use of the Business Profilers website and its services.

Access to and use of the services are reserved for professional users. A professional means any natural or legal person carrying out a commercial, industrial, craft or liberal activity, and any person acting in the name of or on behalf of a professional.

Article 2 - Changes to and duration of the Terms of Use

These terms of use are entered into for an indefinite period. The agreement takes effect with respect to the User from the start of use of the service.

The Business Profilers website reserves the right to modify the clauses of these terms of use at any time and without justification.

Article 3 - Access to the website

Any User with internet access may access the Business Profilers website free of charge and from anywhere. The costs incurred by the User to access it (internet connection, computer equipment, etc.) are not borne by the Publisher.

Every user agrees to:

  • Represent a legal entity or carry out a liberal or craft profession or operate as a sole proprietorship.
  • Use Business Profilers services in a professional capacity and not as a private individual or consumer.

The website and its various services may be interrupted or suspended by the Publisher, in particular for maintenance purposes, without prior notice or justification.

The User of the website has access to the following services:

  • Viewing venue pages

The website includes a member area reserved for registered users. These users may access it using their login credentials.

  • Requesting a quote directly from providers
  • Requesting a quote with support from a Business Profilers project manager
  • Comparing pricing offers
  • Confirming a service with access to providers' quotes and terms and conditions of sale
  • Instant messaging service
  • Ordering ancillary services
  • Booking activities
  • Online reservation tracking service with order history and invoicing
  • Evaluation of seminar services provided by suppliers

Article 4 - Liability

Business Profilers offers an online intermediation service through which providers offer their services to users.

It is specified that Business Profilers acts solely as a service provider company and an online platform operator under the law for a Digital Republic of October 7, 2016.

All information, quotes, invoices, presentations and details entered by the provider cannot engage the liability of Business Profilers. Business Profilers is therefore not responsible for the contractual or pre-contractual information provided by providers in the client area.

The Publisher cannot be held liable in the event of failure, breakdown, difficulty or interruption in operation preventing access to the website or one of its features.

The equipment used to connect to the website is under the User's full responsibility, and the User must take all appropriate measures to protect the equipment and data, in particular from internet-based viral attacks. The User is also solely responsible for the websites and data they consult.

The Publisher cannot be held liable in the event of legal proceedings brought against the User:

  • as a result of the use of the website or any service accessible via the Internet;
  • as a result of the User's failure to comply with these terms and conditions.

The Publisher is not responsible for damage caused to the User, third parties and/or the User's equipment as a result of their connection to or use of the website, and the User waives any action against the Publisher on this basis.

If the Publisher were to be the subject of an amicable or judicial procedure due to the User's use of the website, it may take action against the User in order to obtain compensation for all damage, sums, convictions and costs that may arise from that procedure.

The User is permitted to publish on the Business Profilers website:

  • Messages addressed to the publisher or providers
  • Personal notes
  • Customer comments or reviews
  • Photos or logos
  • Personal information

The User undertakes to make respectful comments toward others and to comply with the law, and accepts that these publications may be moderated or refused by the Publisher, without any obligation to provide justification.

By publishing on the website, the User grants the publishing company the non-exclusive, free-of-charge right to display, reproduce, adapt, modify, distribute and disseminate their publication, directly or through an authorized third party.

The Publisher nevertheless undertakes to mention the member in the event of use of their publication.

Article 5 - Intellectual property

All technical documents, products, photographs, texts, logos, drawings, videos, etc. are subject to copyright and are protected by the Intellectual Property Code. When provided to our clients, they remain the exclusive property of Business Profilers, the sole holder of the intellectual property rights over these documents, which must be returned at its request.

Our clients undertake not to make any use of these documents likely to infringe the provider's industrial or intellectual property rights and undertake not to disclose them to any third party without the Publisher's prior express authorization.

Article 6 - Hyperlinks

The establishment by the User of any hyperlinks to all or part of the website is strictly prohibited, except with the Publisher's prior written authorization, requested by email at the following address: marketing@businessprofilers.fr

The Publisher is free to refuse this authorization without having to justify its decision in any way. Should the Publisher grant authorization, it is in any event only temporary and may be withdrawn at any time, without any obligation on the Publisher to provide justification.

In all cases, any link must be removed at the Publisher's simple request.

Any information accessible via a link to other websites is not under the control of the Publisher, which disclaims all responsibility as to their content.

Article 7 - Protection of personal data

Data collected

  • Account creation: when creating the user's account: surname; first name; email address; phone number; postal address; company, photo, intra-community VAT number;
  • Login: when the user logs into the website, it records, in particular, their surname, first name, connection, usage and location data
